Terms of Service – Benegadget

Effective date: October 4, 2025
Operator: Benegadget, a brand of BeneEra LLC, 30 N Gould St #44190, Sheridan, WY 82801, USA (“Benegadget,” “we,” “us,” “our”).

By accessing https://benegadget.com or purchasing from our store, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our website or services.

1) Use of Our Store

  • You must be the age of majority in your jurisdiction (or have parental consent).
  • You may not use the site for any unlawful or unauthorized purpose.
  • You must not introduce malware, spam, or any code that could disrupt the Service.
  • We may refuse service, cancel orders, or limit quantities at our discretion.

2) Account, Orders & Payment

  • Provide accurate, current information at checkout and when creating accounts.
  • We accept Shopify Payments (Stripe), PayPal, major cards, Apple Pay, Google Pay, Shop Pay.
  • Orders are offers to purchase; acceptance occurs when we email a confirmation/dispatch notice.
  • We may cancel or limit orders (e.g., suspected reseller activity, duplicate accounts, payment concerns). If canceled, we’ll refund the amount paid for the canceled items.

3) Pricing, Availability & Changes

Prices, promotions, and availability may change without notice. We may modify or discontinue products or features at any time. Errors may occur; we reserve the right to correct errors and cancel/refund affected orders.

4) Products, Content & Colors

We aim to display products accurately, but actual colors and finishes may vary by device. Non-material variations (packaging/labeling changes, minor design updates) may occur.

5) Shipping, Processing & Risk of Loss

Processing time: typically 2–6 business days before dispatch. Estimated delivery windows are shown in our Shipping Policy and may vary by region. All orders include free tracked worldwide shipping. Title and risk of loss pass to you when the carrier accepts the package. Tracking is sent by email.

6) Returns & Refunds

Returns are accepted within 14 days after delivery as detailed in our Refund & Return Policy. For non-defective returns, the customer pays return shipping; a 30% restocking fee may apply. Refunds are issued to the original payment method once the item is received and inspected. Items damaged/incorrect on arrival are eligible for replacement or refund—contact support promptly.

7) Third-Party Services & Links

We use trusted providers (e.g., Shopify Payments, PayPal, Google Analytics, Facebook Pixel, Klaviyo, AutoDS). Your data with those providers is handled under their policies. External links are provided for convenience; we are not responsible for third-party sites or resources.

8) Intellectual Property

All content, including logos, graphics, images, text, and site design, is owned by BeneEra LLC or licensed to us and protected by applicable IP laws. You may not copy, reproduce, resell, or exploit any part of the Service without our written consent.

9) User Submissions & Reviews

By submitting reviews, comments, photos, or suggestions (“Submissions”), you grant Benegadget a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for marketing and operational purposes. You warrant your Submissions are lawful, accurate, and do not infringe third-party rights.

10) Prohibited Uses

You agree not to: (a) violate any law; (b) infringe IP or privacy rights; (c) post false, misleading, or harmful content; (d) upload malware or attempt to breach security; (e) scrape/crawl without permission; (f) interfere with site operation; (g) use the Service for abusive, harassing, or discriminatory conduct.

11) Disclaimer of Warranties

The Service and all products are provided “as is” and “as available.” We do not warrant uninterrupted, timely, secure, or error-free operation, nor guarantee specific results.

12) Limitation of Liability

To the fullest extent permitted by law, BeneEra LLC / Benegadget and our officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill arising from your use of the Service or products. Our total liability for any claim shall not exceed the amount you paid for the product(s) at issue. Some jurisdictions do not allow certain limitations; if so, the above applies to the maximum extent permitted.

13) Indemnification

You agree to indemnify and hold harmless BeneEra LLC / Benegadget from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from: (i) your breach of these Terms; (ii) your misuse of the Service; or (iii) your violation of any law or third-party rights.

14) Privacy

Your submission of personal information is governed by our Privacy Policy.

15) Termination

We may suspend or terminate access for any breach of these Terms. Sections that by nature should survive (including IP, warranties, liability, indemnity, dispute resolution) will survive termination.

16) Governing Law & Venue

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. The state and federal courts located in Wyoming shall have exclusive jurisdiction and venue, and you consent to personal jurisdiction in those courts.

17) Arbitration with 30-Day Opt-Out

Important: Except for the matters listed below, any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service (collectively, “Disputes”) will be resolved by binding, individual arbitration administered by a recognized arbitration provider under its applicable rules. You and Benegadget waive any right to a jury trial or to participate in a class action.

  • Small Claims & IP Relief: Either party may bring an individual claim in small claims court, and either party may seek injunctive or other equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
  • Class/Representative Waiver: The arbitrator may not consolidate claims or preside over any class/representative proceeding.
  • 30-Day Opt-Out: You may opt out of arbitration by emailing hello@benegadget.com within 30 days of the date you first agree to these Terms, stating your name, order number (if any), and a clear statement that you wish to opt out of arbitration. Opting out does not affect other provisions of these Terms.
  • Location & Fees: Unless you and Benegadget agree otherwise, arbitration will occur in a reasonably convenient location or by video/teleconference. Each party is responsible for its own fees, except as the arbitrator may otherwise award under applicable law.
  • If this class-waiver is held unenforceable, the entire arbitration section is void, and the Dispute will proceed in court under Section 16.

18) Force Majeure

We are not liable for any delay or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemic/pandemic, labor disputes, supply-chain interruptions, war, terrorism, civil disturbances, utility or internet outages, government actions, carrier delays, or other force-majeure events. Performance is excused for the duration of the event; we will use commercially reasonable efforts to resume performance promptly.

19) Export & Sanctions Compliance

Products may be subject to U.S. and international export control and sanctions laws. You agree to comply with all applicable export, re-export, and sanctions restrictions and represent that you are not located in, under the control of, or a national/resident of any embargoed country or prohibited party list. We may decline or cancel orders that would violate such laws or our compliance policies.

20) BNPL / Shop Pay Installments Disclaimer

Installment options (e.g., Shop Pay Installments) are provided by third-party lenders subject to their eligibility criteria, terms, and privacy policies. Approval, payment schedules, fees, and interest (if any) are determined by the lender, not Benegadget. Using installments does not alter your order total, return eligibility, or our policies; however, lender terms may govern refunds and timing for crediting payments. Please review the lender’s terms during checkout.

21) Changes to These Terms

We may update these Terms from time to time. The latest version is posted here and becomes effective upon posting. Continued use after changes constitutes acceptance.

22) Electronic Communications & Notices

By using the Service, you consent to receive communications electronically (email, website notices). Electronic communications satisfy any legal requirement that such communications be in writing.

23) Entire Agreement & Severability

These Terms, together with our posted policies (e.g., Privacy Policy, Shipping Policy, Refund & Return Policy), constitute the entire agreement between you and Benegadget. If any provision is found unenforceable, the remainder will remain in effect.
