Once we receive a valid DMCA notification, Benegadget will:

  • Remove or disable access to the allegedly infringing material.

  • Notify the seller or user responsible for the content.

  • Take appropriate action against repeat offenders, which may include suspension or permanent account termination.


2. Counter-Notification Procedure

If your content has been removed or disabled and you believe it was a mistake or misidentification, you may file a counter-notice that includes:

  1. Your signature (physical or electronic).

  2. Identification of the material removed and where it previously appeared.

  3. A statement, under penalty of perjury, that you believe the removal was due to mistake or misidentification.

  4. Your full name, address, phone number, and consent to the jurisdiction of the courts in Wyoming, USA, including acceptance of service of process from the complainant.

After receiving a valid counter-notice, we may restore the material unless the original complainant files legal action within 10 business days.


3. Trademark Infringement Reporting

If you believe that a product or listing on Benegadget violates your trademark rights, please provide a written notice including:

  1. Your full legal name and company name (if applicable).

  2. Contact details – physical address, phone number, and email.

  3. Trademark details – the trademarked word, logo, or design, including registration number and jurisdiction (e.g., USPTO).

  4. Infringing content details – specific URLs or product names you believe infringe your mark.

  5. Proof of ownership – such as a trademark registration certificate or relevant documentation.

  6. Good faith statement – declaring that the use is unauthorized and constitutes infringement.

  7. Signature – physical or electronic.

Upon receiving your notice, Benegadget will investigate promptly. Verified infringements may result in removal of the infringing listing, warnings, or account suspension for the seller.


4. Repeat Infringer Policy

Benegadget enforces a strict three-strike policy.
Sellers or users with multiple verified intellectual property violations may have their accounts permanently disabled and be prohibited from future use of our platform.
